Une même faute ne peut être sanctionnée qu’une fois

Un employeur reproche à une salariée une insuffisance professionnelle, un comportement indélicat et un abus de confiance. Compte tenu de ces griefs, il décide de la licencier, après l’avoir entendue dans le cadre d’un entretien préalable.

Mais la salariée rappelle qu’avant cet entretien, elle a déjà reçu, de la part de son employeur, un courrier aux termes duquel il lui adressait un certain nombre de reproches et il l’invitait à changer radicalement et sans délai de comportement sous peine d’un licenciement. Pour elle, il s’agit donc d’un avertissement : elle ne peut plus faire l’objet d’une nouvelle sanction (le licenciement) pour les mêmes faits.

Mais l’employeur considère qu’un courrier qui n’est que le compte rendu d’un entretien au cours duquel il a adressé divers reproches au salarié en le mettant en demeure de modifier son comportement sous peine de sanction à venir ne constitue pas une sanction disciplinaire.

« Et si ! », rappelle le juge : un courrier formulant des reproches précis à la salariée, l’invitant instamment à changer radicalement et sans délai de comportement sous peine de licenciement disciplinaire constitue un avertissement. Ces faits, déjà sanctionnés, ne peuvent plus justifier un licenciement ultérieur, même pour insuffisance professionnelle.
