Une entreprise se sépare de son VRP. Celui-ci conteste son licenciement et réclame le paiement d’indemnités… sur la base d’un temps complet. Sauf qu’en tant que VRP multicarte, il ne consacre pas l’ensemble de son activité à la société, rétorque l’employeur…


Temps partiel : comment le prouver ?

Un VRP conteste son licenciement et réclame la requalification de son contrat à temps partiel en contrat à temps complet.

Ce que conteste à son tour l’employeur qui rappelle qu’il a été employé comme VRP multicarte. Il est donc évident, selon l’employeur, que le salarié ne consacrait pas l’ensemble de son activité de VRP à la société qui l’employait.

Mais le juge précise que seule la mention de la durée hebdomadaire ou mensuelle de travail permet de qualifier le contrat de contrat à temps partiel. A défaut d’une telle mention, l’employeur doit rapporter la preuve de la durée de travail convenue, cette preuve ne se déduisant pas de sa qualité de VRP multicarte.
