Parce qu’un viticulteur achète une partie des raisins qu’il pressure à d’autres producteurs, l’administration fiscale lui refuse le bénéfice de l’exonération de taxe foncière réservée aux bâtiments agricoles. A tort ou à raison ?


Viticulteurs : et si vous pressurez du raisin récolté par des tiers ?

A l’issue d’un contrôle fiscal, l’administration refuse à un viticulteur le bénéfice d’une exonération de taxe foncière.

Elle rappelle, en effet, que cet avantage fiscal ne concerne que les bâtiments affectés à un usage agricole, c’est-à-dire à la réalisation d’opérations qui s’insèrent dans le cycle biologique de la production animale ou végétale, ou qui constituent le prolongement d’une activité agricole.

Or, ici, le viticulteur :

  • pressure dans ses bâtiments plus de 277 000 kg de raisins provenant de sa propre récolte dont une partie est affectée à la vinification, l’autre étant vendue en négoce sous forme de moût ;
  • pressure, toujours dans ses bâtiments, près de 30 000 kg de raisins récoltés par des tiers.

En conséquence, et parce qu’il achète à d’autres producteurs environ 35 % du total des raisins qu’il pressure sur son domaine, l’administration considère que les locaux du viticulteur ne sont pas affectés à un usage agricole.

Une position que ne partage pas le juge, qui invite l’administration à revoir sa copie. Affaire à suivre…
