A l’occasion de la vente de 4 places de parking, un couple demande à bénéficier de l’exonération d’impôt sur le gain réalisé qui profite aux ventes immobilières d’un montant inférieur à 15 000 €, ce que lui refuse l’administration, qui a sorti sa calculatrice…


Vente immobilière : un seuil d’exonération par transaction !

Un couple, propriétaire en indivision de 4 emplacements de parking situés dans un même immeuble, décide de les vendre à un même acheteur, pour un montant total de 93 000 €.

Après avoir déclaré le gain réalisé et payé l’impôt correspondant, le couple demande finalement à l’administration de lui accorder le bénéfice de l’exonération d’impôt réservée aux ventes immobilières dont le montant est inférieur à 15 000 €.

Le couple raisonne, en effet, de la façon suivante :

  • ils ont vendu 4 places de parking à un même acquéreur, au sein du même acte de vente, pour un montant total de 93 000 €, ce qui revient à dire que chaque place a été vendue pour un montant de 23 250 € (93 000 €/4) ;
  • les époux étant propriétaires en indivision des places vendues, chacun d’eux a, en réalité, touché 11 625 € par emplacement de parking cédé (23 250 €/2), soit un montant inférieur au seuil d’exonération fixé à 15 000 €.

Un raisonnement qui ne convainc ni l’administration fiscale, ni le juge : pour déterminer le prix de vente devant être comparé au seuil de 15 000 €, il faut tenir compte de chaque transaction réalisée, indépendamment du nombre d’emplacements de parking vendus à cette occasion.

Ici, puisqu’il n’y a eu qu’une seule et unique vente, pour un montant de 93 000 €, le couple ne pourra pas prétendre au bénéfice de l’exonération d’impôt.
