Le bailleur-vendeur reste responsable de ses propres fautes !

Un bailleur vend son local commercial loué. Dans l’acte de vente, il prend soin de préciser que l’acquéreur est désormais seul responsable de l’entretien du local et de ses équipements.

Sauf que suite à la vente, le locataire se plaint du dysfonctionnement du chauffage et du mauvais état du local… et engage la responsabilité du nouveau bailleur, mais aussi de l’ancien ! Pour lui, l’ancien propriétaire n’a rien fait pour résoudre ces problèmes, qui étaient déjà présents avant la vente : il a donc commis une faute qui engage sa responsabilité, même si le local ne lui appartient plus.

Ce que confirme le juge : parce que le vendeur n’a pas rempli ses obligations de bailleur avant la vente, il reste responsable du mauvais état du local, même après la vente. Ancien et nouveau bailleurs sont donc tous les deux condamnés à indemniser le locataire !
