Un marchand de biens revend des appartements tous situés dans un même ensemble immobilier. Et l’administration fiscale s’est intéressée tout particulièrement à la revente d’un de ces lots, pour lequel elle a estimé le prix de revente trop bas par rapport aux autres lots. Acte anormal de gestion, et donc redressement fiscal, en vue ?


Acte anormal de gestion : l’administration doit le prouver !

Un marchand de biens a vendu les lots n° 5, 6, 7 et 8 d’un ensemble immobilier. Au cours d’un contrôle fiscal, l’administration a analysé les ventes de ces lots et a constaté que le marchand de biens a vendu le lot n° 5 à un prix anormalement bas en comparaison des prix auxquels il a cédé les autres lots.

Pour l’administration, le marchand de biens a commis un acte anormal de gestion : elle rectifie donc le résultat imposable du marchand de biens.

Mais, pour ce dernier, il ne suffit pas de constater un écart de prix entre le lot cédé et le prix de vente d’autres lots. Il souligne que le lot n° 5 n’a pas été vendu dans le même état d’achèvement que les autres lots vendus au même moment. C’est ce qui explique que son prix de vente soit inférieur à celui des autres lots.

Ce qui suffit, pour le juge, à démontrer que l’administration fiscale a tort dans cette affaire. Pour démontrer que le marchand de biens a commis un acte anormal de gestion, qui justifierait un redressement fiscal, il faut qu’elle apporte la preuve qu’il n’a pas agi dans son intérêt, ni dans celui de son activité, et ce, intentionnellement. Ce qu’elle ne prouve pas ici…
