Une SCI vend un chalet, après y avoir fait réaliser quelques travaux dans le sous-sol et dans les étages.

L’acte de vente comporte une attestation de l’architecte certifiant que tous les travaux réalisés dans le chalet sont conformes à ceux indiqués dans le permis de construire. En outre, un plan du sous-sol aménagé, signé par l’architecte, est également remis à l’acquéreur.

Par la suite, l’acquéreur veut réaménager le sous-sol : il apprend alors qu’aucune autorisation d’urbanisme n’a été sollicitée pour les travaux réalisés dans le sous-sol.

Pourtant, l’architecte a attesté que tous les travaux réalisés dans le chalet étaient conformes au permis de construire. Il s’agit en fait d’un mensonge de l’architecte visant à rassurer l’acquéreur pour l’inciter à acheter le chalet. En réalité, les travaux mentionnés dans le permis de construire ne concernaient pas le sous-sol. Les travaux qui y ont été réalisés sont donc illégaux.

Mécontent, l’acquéreur va réclamer des dommages-intérêts à la SCI, avec laquelle il est lié contractuellement, pour dissimulation de travaux réalisés sans autorisation d’urbanisme. Pour lui, l’architecte, qui agit en qualité de représentant de la SCI puisque celle-ci l’a mandaté pour fournir une attestation de conformité des travaux réalisés, a engagé la responsabilité de la SCI en délivrant une attestation mensongère.

Mais la SCI estime que sa responsabilité n’est pas engagée, faute pour l’acquéreur de prouver qu’elle a eu connaissance des informations mensongères données par l’architecte.

… à tort, selon le juge : l’architecte, représentant effectivement la SCI en vertu du mandat confié, s’est rendu coupable d’une manœuvre dolosive qui engage la SCI en délivrant une attestation mensongère. La SCI doit donc indemniser l’acquéreur.
