Parce qu’elle a encaissé un acompte pour l’exécution de travaux de transformation d’un corps de ferme, l’administration fiscale réclame à une société le reversement de la TVA collectée à cette occasion… Ce que cette dernière refuse, n’étant pas tout à fait certaine de mener à bien ce chantier… A tort ou à raison ?


TVA : êtes-vous certain que vous allez faire les travaux ?

En matière de prestations de services, et notamment de travaux immobiliers, la TVA est due au moment de l’encaissement des acomptes, du prix des mémoires et des factures finales, sauf option pour les débits : concrètement, le professionnel doit donc décaisser la TVA au moment où il encaisse ces sommes.

Toutefois, le juge vient de rappeler dans le cadre d’un litige opposant l’administration fiscale à une société de construction que la TVA était exigible au moment de l’encaissement des acomptes, seulement si :

  • tous les éléments pertinents de la future prestation sont déjà connus à ce moment-là ;
  • la réalisation de la prestation n’est pas incertaine.

Or, dans cette affaire, la société a encaissé un acompte pour des travaux de transformation d’un corps de ferme en 15 appartements avant même la délivrance d’un permis de construire.

Dès lors, parce qu’à la date du versement, il n’était pas certain que les travaux soient effectivement réalisés, la société n’avait pas à reverser la TVA collectée à l’administration fiscale au moment de l’encaissement de l’acompte.

Notez que dans une telle situation, la TVA devra de toute façon être versée à l’administration fiscale au plus tard au moment de la réalisation de la prestation de travaux.
