Un employeur licencie un salarié, puis signe avec lui une transaction. Cependant, l’un des engagements de l’employeur reste en suspens pendant près d’un an. De quoi annuler la transaction et contester le licenciement, d’après le salarié…


Transaction inexécutée = licenciement contestable

Un employeur licencie un salarié, lui-même dirigeant par ailleurs d’une société de pose de panneaux photovoltaïques pour son propre compte. L’employeur et le salarié signent une transaction par laquelle l’employeur verse au salarié une certaine somme d’argent et s’engage à faire poser des panneaux photovoltaïques par la société du salarié.

Or, parce qu’après environ un an d’attente, son ex-employeur ne lui donne aucune nouvelle, malgré ses relances, l’ancien salarié conteste la transaction et son licenciement. Ce qui ne pose pas de difficultés pour l’employeur qui considère que la transaction reste valable et que le salarié ne peut donc pas contester son licenciement.

Mais le juge donne raison au salarié : l’inexécution de la transaction (fût-elle partielle) constitue un manquement suffisamment grave aux obligations résultant de la transaction pour en justifier l’annulation. Et parce que la transaction est annulée, le salarié peut contester son licenciement.

Et dans cette affaire, le licenciement était, effectivement, contestable, ce qui a permis au salarié d’obtenir des indemnités de licenciement abusif.

Retenez donc que la transaction permet de neutraliser une contestation du salarié, à condition d’en respecter les termes !
