Une entreprise reçoit un courrier dans lequel une salariée dénonce des malversations qui seraient commises par une autre salariée. L’employeur procède à une enquête interne qui ne révèle aucun acte de ce type. La salariée mise en cause demande alors communication du courrier. Que faire dans ce cas ?


Dénonciation calomnieuse = infraction

Au préalable, rappelons ce qu’est une dénonciation calomnieuse : il s’agit de la dénonciation d’un fait pouvant entraîner des sanctions judiciaires, administratives ou disciplinaires à l’encontre d’une personne et que l’on sait totalement ou partiellement inexact.

Cette infraction implique donc une certaine mauvaise foi de l’auteur de la dénonciation. Elle est passible d’un emprisonnement de 5 ans maximum et d’une amende de 45 000 € au plus.

Dans une affaire récente, une entreprise a reçu un courrier dénonçant des malversations supposément commises par une de ses salariées. Elle procède donc à une enquête et à l’audition de la salariée mise en cause. Les faits s’avérant inexacts, l’entreprise ne donne pas de suite au courrier.

Mais la salariée mise en cause réclame la communication de ce courrier. Communication inutile, selon l’employeur, puisqu’il n’a pas pris de sanction contre elle.

Certes, en convient le juge, mais à partir du moment où la salariée pourrait demander réparation d’une dénonciation calomnieuse, elle dispose d’un motif légitime à obtenir la communication de ce courrier. Peu importe que l’entreprise n’ait pas pris, ou ni même envisagé de prendre, des sanctions contre elle.
