Contrat de travail à temps partiel = contrat écrit !

Une salariée est employée à temps partiel par une entreprise, mais elle déplore ne pas avoir reçu, ni signé de contrat régulier. Et, rappelle-t-elle, en l’absence d’écrit, le contrat est présumé être à temps complet.

Elle réclame donc la requalification de son contrat à temps complet et le rappel de salaires correspondant.

Mais l’employeur rappelle à son tour qu’il lui est possible de rapporter la preuve que le contrat est bien un contrat partiel. A défaut, il doit, certes, rapporter la preuve de la durée exacte hebdomadaire ou mensuelle convenue, mais aussi que le salarié n’est pas placé dans l’impossibilité de prévoir à quel rythme il doit travailler et qu’il n’a donc pas à se tenir constamment à sa disposition.

Or, ici, la salariée n’est manifestement pas placée dans la possibilité de prévoir à quel rythme elle doit travailler, ce qui laisse entendre qu’elle doit se tenir constamment à la disposition de l’employeur, constate le juge qui va dans le sens de la salariée…
