Ne trouvant pas de locataire pour sa maison, un propriétaire demande à bénéficier du dégrèvement de taxe foncière réservé aux logements vacants. Mais pour l’administration, cet avantage fiscal ne s’applique que pour les logements destinés à la location… pas à ceux mis en vente… Vrai ou faux ?

Parce qu’il ne trouve pas de nouveau locataire pour une maison qui lui appartient, un propriétaire décide finalement de la mettre en vente et demande, en attendant, à bénéficier du dégrèvement de taxe foncière réservé aux locaux vacants.

Ce que lui refuse l’administration qui rappelle que le bénéfice de cet avantage fiscal suppose que la vacance du logement, normalement destiné à la location, soit indépendante de la volonté du propriétaire.

Or, ici, le logement n’est pas proposé à la location : il est mis en vente. Une circonstance qui, à elle seule, suffit à priver le propriétaire du bénéfice du dégrèvement de taxe foncière.

« Non », conteste le propriétaire, qui rappelle à son tour :

  • que dès le départ de ses anciens locataires, il a confié un mandat de recherche de nouveaux locataires à une agence immobilière ;
  • qu’il a renouvelé ce mandat pendant plusieurs mois, tout en réduisant le loyer demandé, celui-ci étant finalement fixé à un montant au m² inférieur au prix moyen de location sur la commune ;
  • que sa situation financière est devenue délicate, dès lors que les échéances de l’emprunt souscrit pour l’achat de la maison n’étaient plus couvertes par des revenus locatifs, ce qui l’a contraint à mettre en vente la maison ;
  • que même si la maison a été mise en vente, il a poursuivi ses démarches pour trouver de nouveaux locataires.

Il a donc bien droit au bénéfice de cet avantage fiscal.

Ce que confirme le juge, qui annule le redressement fiscal : la seule circonstance qu’un bien effectivement proposé à la location soit mis en vente n’est pas de nature à priver son propriétaire du bénéfice du dégrèvement de taxe foncière réservé aux locaux vacants.
