En 2016, le régime de TVA applicable aux sociétés civiles d’attribution (SCA) a été modifié. Depuis cette date, nous étions en attente de précisions… qui viennent tout juste de nous être apportées…


Sociétés civiles d’attribution : TVA sous conditions…

Le régime de TVA français fonctionne selon le postulat suivant : pour calculer la TVA qu’elle doit reverser à l’administration, une société (soumise à TVA) doit retrancher de la TVA qu’elle facture à ses clients la TVA qu’elle a elle-même payée à ses fournisseurs (ce que l’on appelle le « droit à déduction »).

En 2016, le régime de TVA des sociétés civiles d’attribution (SCA) a été modifié suite à la suppression du mécanisme de transfert du « droit à déduction » pour les constructions ou les acquisitions d’immeubles pour lesquels un état descriptif de division a été établi depuis le 1er janvier 2016.

Mais depuis cette date, aucune précision n’avait été apportée. C’est dorénavant chose faite !

Désormais, les SCA sont soumises à TVA pour leurs activités de promotion immobilière, sous réserve :

  • que ces activités soient financées par les apports de leurs associés ;
  • que ces apports soient soumis à la TVA.

En contrepartie, les SCA bénéficieront du « droit à déduction » de la TVA : elles pourront donc récupérer la TVA payée à leurs fournisseurs.

De leur côté, les associés pourront, eux aussi et toutes conditions par ailleurs remplies, récupérer la TVA appliquée sur le montant de leurs apports.
