Une société française, condamnée par un tribunal américain à verser des « punitive damages » à un partenaire commercial, demande à les déduire de son résultat imposable pour le calcul de son impôt sur les bénéfices… Ce que lui refuse l’administration fiscale. A tort ou à raison ?


Distinguer les sanctions commerciales des sanctions légales…

Pour le calcul de l’impôt sur les bénéfices, les pénalités et amendes prononcées à l’encontre de l’entreprise qui contrevient à une obligation légale ne sont jamais déductibles de son résultat imposable.

A l’inverse, les « punitive damages », c’est-à-dire les dommages et intérêts punitifs ou exemplaires versés à une victime, notamment dans le cadre de litiges commerciaux, sont déductibles.

Cela résulte du fait que ces indemnités, qui ne sont pas versées à une autorité publique, ne viennent pas sanctionner le non-respect d’une obligation légale, mais plutôt réprimer un comportement particulièrement dommageable dans le cadre de relations commerciales.

Elles ne sont donc pas assimilables à une pénalité ou une amende dont la déduction est normalement interdite.

C’est précisément ce que vient de rappeler le juge à l’administration, en autorisant une société française à déduire de son résultat imposable les « punitive damages » qu’elle a été condamnée à payer à l’un de ses partenaires commerciaux.
