Entretien préalable et sanction disciplinaire : attention à votre convention collective !

Mais le salarié conteste : la convention collective applicable à l’association prévoit que lorsque l’employeur envisage de prononcer une sanction, il doit convoquer le salarié à un entretien préalable, sauf si la sanction n’a pas d’incidence sur la présence du salarié dans l’entreprise, sa fonction, sa carrière ou sa rémunération.

Et parce qu’ici, il n’a jamais été convoqué à un entretien préalable avant d’être sanctionné, alors même que les sanctions en cause avaient une incidence sur sa présence dans l’entreprise, le salarié demande que son licenciement soit reconnu sans cause réelle et sérieuse.

Toutefois, même si l’employeur n’a pas respecté la procédure prévue par la convention collective, le juge donne tort au salarié : l’argument soulevé, suffisant pour obtenir l’annulation des 2 sanctions, ne lui permet pas, pour autant, d’obtenir la requalification du licenciement pour faute grave en licenciement sans cause réelle et sérieuse.
