Un licenciement motivé par l’état de santé du salarié sera, en cas de contentieux, déclaré nul. Mais tout licenciement prononcé à l’encontre d’un salarié malade n’est pas automatiquement nul. Voici 2 exemples récents de licenciements (justifiés ou non) prononcés contre un salarié malade…


Licencier un salarié malade = discrimination ?

Dans 2 affaires récentes, des salariés ont contesté leur licenciement, s’estimant victimes d’une discrimination.

Dans la première, le salarié a fait l’objet d’un arrêt de travail en raison de son état dépressif. Il a adressé un email à son employeur pour l’informer de la dégradation de son état de santé, liée à son travail.

Peu de temps après, l’employeur l’a licencié pour insuffisance professionnelle.

Mais parce que la procédure de licenciement a été engagée 8 jours après la réception de l’email et que l’employeur n’est pas parvenu à justifier de l’insuffisance professionnelle du salarié, ce dernier semble effectivement victime d’une discrimination en raison de son état de santé…

… Ce qui justifie la nullité de son licenciement, d’après le juge.

Dans une seconde affaire, une salariée est déclarée apte à travailler à temps partiel après avoir travaillé pendant plusieurs années en mi-temps thérapeutique. Elle signe alors un avenant à son contrat de travail pour un travail à temps partiel.

L’employeur la licencie 10 mois plus tard au motif que ses absences répétées et son temps partiel perturbent l’organisation et le bon fonctionnement du service (agence de l’entreprise) qu’elle occupe. La salariée y voit là une discrimination reposant sur son état de santé.

Mais cette fois, le juge constate que ses absences répétées désorganisent effectivement l’entreprise, ce qui justifie son licenciement.
