La rupture conventionnelle est un mode amiable de rupture du contrat de travail entre l’employeur et le salarié, qui répond à un formalisme strict. A ce titre, la dernière étape de cette procédure est amenée à évoluer… De quelle façon ?


Rupture conventionnelle : la procédure d’homologation évolue

Pour être valable, la rupture conventionnelle doit respecter un formalisme strict.

Ainsi, au minimum un entretien préalable doit être réalisé pour permettre à l’employeur et au salarié d’échanger au sujet de cette rupture de contrat.

A l’issue de cet entretien, une convention doit être rédigée et signée, dont un exemplaire doit être remis au salarié qui dispose, comme l’employeur, d’un délai de rétractation de 15 jours calendaires (qui commence à courir dès la signature de la convention).

Passé ce délai, cette convention doit être homologuée par l’inspection du travail.

Actuellement, cette demande d’homologation, idéalement faite par courrier en recommandé avec accusé de réception, est adressée à la Direction régionale de l’économie, de l’emploi, du travail et des solidarités (DREETS), qui dispose de 15 jours pour se prononcer.

Retenez qu’à compter du 1er avril 2022, les demandes d’homologation devront impérativement être déposées par voie dématérialisée : il ne sera donc plus possible de les envoyer par courrier, sauf si l’une des parties indique être dans l’impossibilité de recourir au téléservice.
