La rupture conventionnelle, comme son nom l’indique, formalise l’accord du salarié et de l’employeur concernant la rupture du contrat, à l’aide d’une convention qu’ils rédigent eux-mêmes. Mais encore faut-il que le consentement du salarié ne soit pas vicié… comme vient justement de le rappeler un juge…


Rupture conventionnelle = accord

Une salariée signe avec son employeur une rupture conventionnelle et, quelque temps plus tard, elle en demande finalement la nullité.

Le motif ? Au jour de la signature de la convention de rupture, son consentement n’était pas libre et éclairé puisqu’elle subissait un harcèlement sexuel de la part de l’un de ses supérieurs. Elle n’a donc pas eu d’autre choix que d’accepter cette rupture conventionnelle…

Et parce que l’employeur avait connaissance des faits de harcèlement et n’a pas mis en place les mesures nécessaires pour la protéger, le juge donne raison à la salariée et prononce la nullité de la rupture conventionnelle.

Pour mémoire, la rupture conventionnelle est un mode de rupture du contrat de travail conclu d’un commun accord entre l’employeur et le salarié. Cela suppose donc une décision prise en toute connaissance de cause lors de la signature de la convention formalisant cette rupture.
