Le propriétaire d’un immeuble placé en location se fait rembourser le montant de la taxe foncière par son locataire. Pour le calcul de son impôt, il demande à déduire la taxe foncière de ses revenus fonciers, ce que l’administration lui refuse. Pourquoi ?

Le propriétaire d’un immeuble et son locataire ont convenu, dans le cadre d’un contrat de bail, que ce dernier assumerait la charge financière de la taxe foncière : plus simplement, il est prévu que le locataire rembourse le montant de cette taxe au propriétaire.

Quelques temps plus tard, au moment de déclarer ses revenus imposables, le propriétaire demande à pouvoir déduire la taxe foncière de ses revenus fonciers.

Une demande rejetée par l’administration fiscale et par le juge, qui rappellent que pour pouvoir déduire la taxe foncière, le propriétaire aurait dû commencer par ajouter le remboursement à ses revenus imposables, ce qu’il n’a pas fait.

Notez que dans une telle situation, il existe une tolérance administrative qu’il peut être opportun d’appliquer, et qui consiste à faire purement et simplement abstraction de la taxe foncière, tant en recettes qu’en dépenses : vous n’incluez par le montant du remboursement dans vos recettes, et vous ne déduisez par le montant correspondant pour le calcul de votre impôt.
