Sur les réseaux sociaux, de nombreux influenceurs font de la publicité en faveur de l’alcool, sans pour autant inscrire les mentions normalement obligatoires qui sont prévues par la loi Evin. Est-ce licite ?


Réseaux sociaux = respect de la loi Evin

En France, la réglementation encadrant la publicité de l’alcool est connue sous le nom de « loi Evin ».

Elle prévoit, notamment, que la publicité, directe ou indirecte, en faveur de l’alcool sur les services de communications (télévision, ordinateur, radio, etc.) est interdite lorsqu’elle vise la jeunesse.

En outre, toute publicité en faveur de l’alcool doit être assortie d’un message de caractère sanitaire précisant que « l’abus d’alcool est dangereux pour la santé ».

Enfin, la publicité est limitée à l’indication du degré volumique d’alcool, de l’origine, de la dénomination, de la composition du produit, du nom et de l’adresse du fabricant, des agents et des dépositaires, ainsi que du mode d’élaboration, des modalités de vente et du mode de consommation du produit.

La loi Evin doit être impérativement respectée par les « influenceurs » et les marques qui signent des contrats avec eux. A défaut, ils peuvent être attaqués en justice. A cet effet, notez que le gouvernement a habilité des associations de lutte contre les addictions à agir en justice et à veiller au respect de la réglementation.
