Une entreprise recourt aux services d’un travailleur indépendant dans le cadre d’un contrat de prestation de services. Sauf que ce dernier s’estime, en réalité, salarié de l’entreprise. Outre la requalification de son contrat, il demande une indemnité pour travail dissimulé. A tort ou à raison ?


Contrat « inapproprié » = travail dissimulé ?

Une entreprise conclut un contrat de prestation de services avec un travailleur indépendant… que ce dernier va finalement contester avec succès. Sa relation de travail relève, effectivement, du salariat.

Mais s’il est salarié, l’employeur doit procéder à une déclaration d’embauche et payer des cotisations sociales, précise-t-il, ce qui n’a pas été le cas. Or, un manquement aux obligations déclaratives et aux obligations de paiement des cotisations sociales peut relever du travail dissimulé, souligne le salarié. Il y voit alors l’opportunité d’obtenir une indemnité pour travail dissimulé (correspondant à 6 mois de salaire).

Sauf que l’infraction de travail dissimulé implique une intention de l’employeur de dissimuler l’emploi, précise le juge. Et cette intention ne peut pas se déduire du seul recours à un contrat inapproprié, ajoute-t-il. Faute de prouver cette intention, le salarié ne peut pas prétendre à une indemnité pour travail dissimulé.
