Les entreprises du bâtiment confrontées à la hausse du coût des matériaux vont-elles pouvoir bénéficier d’un remboursement immédiat de leurs créances de « carry back » non encore utilisées ? Réponse du gouvernement…


Entreprises du bâtiment et gestion des déficits : pas de changement

Une entreprise, soumise à l’impôt sur les sociétés (IS), qui constate un déficit a 2 options :

  • elle peut soit l’imputer sur le bénéfice imposable réalisé au titre d’un exercice suivant, ce qui va lui permettre de générer une économie d’impôt future ;
  • ou elle peut choisir d’opter pour le report en arrière du déficit subi (ce que l’on appelle un « carry back ») : concrètement, l’entreprise impute le déficit subi au titre de son dernier exercice sur le bénéfice de l’exercice précédent.

L’option pour le « carry-back » fait naître une créance fiscale, qui correspond, en pratique, à l’excédent d’IS antérieurement versé. Cette créance fiscale pourra être utilisée pour payer l’IS à verser au titre des exercices suivants. A défaut d’imputation possible dans les 5 ans, cette créance fiscale est remboursée.

En 2020, dans le cadre de la crise sanitaire, le gouvernement a temporairement autorisé, sous conditions, le remboursement immédiat des créances de « carry back » non encore utilisées.

Actuellement, au regard de la hausse du coût des matériaux, il a été demandé au gouvernement de réactiver cette possibilité de remboursement immédiat pour les entreprises du secteur du bâtiment.

La réponse est négative.
