Redressement judiciaire : quel acte (ne) pouvez-vous (pas) accomplir seul ?

Pour mémoire, la procédure de redressement judiciaire vise à placer une entreprise sous le contrôle du juge afin d’organiser le règlement de ses dettes et la poursuite de son activité.

Dans ce cadre, l’entreprise concernée peut, en principe, accomplir tous les actes de gestion nécessaires à la poursuite de son activité.

Par exception toutefois, elle est dans l’obligation de solliciter l’autorisation du juge-commissaire désigné par le tribunal pour pouvoir effectuer un « acte de disposition » étranger à la gestion courante.
