Pour protéger ses créations, il existe plusieurs dispositifs tels que les dépôts de brevet, de marque, etc. Les créateurs peuvent également utiliser un service plus simple et moins couteux pour commencer, le service e-Soleau…


Comment fonctionne le service e-Soleau ?

Pour prouver l’existence d’une création à une date donnée, les créateurs peuvent déposer « une enveloppe Soleau ». Celle-ci présente 2 avantages :

  • la simplicité ;
  • le faible coût.

Dans ce cadre, vous pouvez déposer vos documents en version dématérialisée (images, PDF, vidéos, etc.), via le service e-Soleau, disponible sur la plateforme : https://www.inpi.fr/fr/services-et-prestations/e-soleau.

Une fois déposés, ils seront conservés pendant 5 ans par l’INPI. A l’expiration de ce délai, celui-ci peut être reconduit une fois, pour une nouvelle durée de 5 ans.

Le coût de ce dépôt est de 15 € pour 10 Mo de fichiers, puis 10 € tous les 10 Mo supplémentaires. Notez toutefois que le nombre de fichiers par dépôt est limité : 3 fichiers et 300 Mo maximum.

En cas de litige vous pourrez demander la restitution de l’e-Soleau, afin de prouver au juge que vous étiez bien en possession de la création concernée à une date précise.

Pour finir, retenez que ce dispositif ne se substitue pas à un dépôt de titre de propriété industrielle auprès des services de l’Institut national de la propriété industrielle (INPI), tel que le dépôt de brevet, de marque, de modèle, etc. Il s’agit simplement d’une étape préalable ou complémentaire.
