Un promoteur livre en retard un appartement à un couple qui comptabilise 112 jours de pénalités de retard. Mais pour le promoteur, il y a (seulement) 42 jours de pénalités de retard. Pour arriver à ce résultat différent, il retient un mode de calcul particulier : lequel ?


Promoteur : doubler les jours de retard pour intempéries, est-ce abusif ?

Un promoteur vend un appartement à un couple sous le régime de la vente en l’état futur d’achèvement (VEFA).

Parce que le promoteur livre l’appartement avec 210 jours de retard, le couple réclame l’application de 112 jours pénalités de retard, en déduisant 70 jours au titre d’un arrêt de chantier pour intempérie et 28 jours au titre des week-ends.

Mais le promoteur considère qu’il a livré l’appartement avec 42 jours de retard : il explique alors qu’il faut comptabiliser 2 fois les jours d’arrêts de chantier pour intempéries, comme le contrat de VEFA le prévoit.

« Non », répond le couple : il rappelle qu’il a le statut de « consommateur » et le promoteur celui de « professionnel ».

Or, la Loi comporte des dispositions protectrices du « consommateur », dont l’une prévoit que sont abusives et nulles les clauses qui créent un déséquilibre significatif entre les droits et obligations des « consommateurs » et des « professionnels ».

Et, selon le couple, la clause consistant à doubler les jours de retard pour intempéries, non prises en compte pour le calcul des pénalités de retard, par rapport à ceux effectivement enregistrés, en raison de leur répercussion sur l’organisation générale du chantier, est abusive et nulle car elle permet au promoteur de réduire très sensiblement l’indemnisation normalement due.

Mais pour le juge, la clause litigieuse n’est pas abusive. Il confirme qu’elle doit s’appliquer, permettant ainsi au promoteur de réduire le montant des indemnités dues au couple.
