Lorsqu’un salarié est déclaré inapte, l’employeur doit rechercher des reclassements, puis consulter les représentants du personnel au sujet des postes qu’il envisage de proposer au salarié. C’est, du moins, ce que rappelle un salarié à son employeur…

Un salarié protégé est déclaré inapte à son poste. Son employeur lui propose 2 postes de reclassement, que le salarié refuse.

Puis, s’apercevant qu’il a omis de solliciter l’avis des représentants du personnel quant à ces propositions de reclassement, l’employeur les convoque afin de régulariser la procédure. Ceux-ci émettent alors un avis favorable sur les 2 postes concernés.

L’employeur propose donc à nouveau ces 2 mêmes postes au salarié protégé, qui les refuse une nouvelle fois. Il sollicite donc l’autorisation de l’inspecteur du travail afin de licencier ce salarié. Autorisation qu’il obtient.

Ce que conteste le salarié : il rappelle que la consultation des représentants du personnel doit être préalable aux propositions qui lui sont faites. Or, l’employeur lui a proposé les 2 postes de reclassement avant de consulter les représentants du personnel…

… et de les lui proposer à nouveau, rappelle le juge pour qui l’employeur a bien régularisé la procédure en proposant des reclassements après consultation des représentants du personnel. Peu importe qu’il s’agisse des 2 mêmes postes…
