Travailleur indépendant = « indépendant »

Une plateforme web de mise en relation spécialisée dans le transport de personnes a supprimé le compte de l’un de ses chauffeurs. Décision qui s’apparente à un licenciement, d’après le chauffeur, qui réclame alors à la plateforme Web des indemnités…

Pour justifier sa demande, il rappelle que la plateforme Web fixe le prix de ses prestations, lui interdit notamment de prendre d’autres passagers avant l’achèvement d’une course, lui impose ses itinéraires, etc. Ce qui caractérise, selon lui, l’existence d’un lien de subordination…

Et, en effet, le juge a ainsi pu rappeler un certain nombre de critères du travail indépendant et notamment :

  • la possibilité de se constituer une clientèle propre,
  • la liberté de fixer ses tarifs,
  • la liberté de définir les conditions d’exécution de sa prestation de service.

Or, ici, le chauffeur ne se constitue pas une clientèle propre, ses tarifs sont fixés par la plateforme qui lui impose, par ailleurs, un itinéraire (s’il ne le suit pas, elle applique des corrections tarifaires). Le juge en conclut donc que son statut d’indépendant est fictif.

Il constate également, que la plateforme Web exerce un pouvoir disciplinaire puisqu’elle a la faculté de déconnecter le compte d’un chauffeur, après 3 refus de courses, voire de le supprimer complètement en cas de dépassement d’un taux d’annulation de commande, ou de signalements de « comportements problématiques ».

Le chauffeur était donc effectivement salarié, ce qui lui permet d’obtenir des indemnités.
