Pour quelques années encore, les entreprises soumises à l’impôt sur le revenu au titre d’un régime réel d’imposition qui n’adhèrent pas à un organisme de gestion agréé sont pénalisées : pour le calcul de l’impôt, leur base d’imposition fait l’objet d’une majoration. Comment la calculer ?


Une majoration qui s’applique au montant du revenu catégoriel

Pour rappel, les entreprises relevant de l’impôt sur le revenu, et soumises à un régime réel d’imposition (régime simplifié ou normal pour les commerçants, artisans, industriels, et régime de la déclaration contrôlée pour les professions libérales), qui n’adhèrent pas à un organisme de gestion agréé (OGA) ou qui ne font pas appel à un expert-comptable pour l’établissement de leur résultat fiscal sont pénalisées.

Initialement, leur base d’imposition était majorée de 25 % (application d’un coefficient de 1,25).

Toutefois, cette majoration va être progressivement supprimée. Il est donc prévu que le coefficient appliqué au résultat fiscal pour déterminer le montant imposable soit fixé à :

  • 1,2 pour l’imposition du résultat 2020,
  • 1,15 pour l’imposition du résultat 2021,
  • 1,1 pour l’imposition du résultat 2022,
  • 1 pour l’imposition du résultat 2023.

Dans le cadre d’un litige opposant une entreprise à l’administration fiscale sur le calcul de cette majoration, le juge de l’impôt vient de rappeler qu’elle s’applique au montant du revenu catégoriel de l’année d’imposition résultant de l’activité qui ne relève pas d’un OGA.

Elle ne s’applique donc pas au bénéfice déterminé après imputation des déficits catégoriels reportables des années antérieures, dès lors que ces déficits peuvent provenir d’activités non professionnelles différentes ou d’activités relevant d’un OGA.
