Tout employeur qui occupe au moins 20 salariés est tenu à diverses obligations en faveur de l’emploi des travailleurs handicapés (OETH). A compter du 1er janvier 2022, certains calculs relatifs à cette obligation sont modifiés. De quelle façon ?


Une modification dérogatoire

Les employeurs d’au moins 20 salariés sont tenus :

  • d’employer des travailleurs handicapés à hauteur d’un pourcentage de leur effectif salarié ;
  • ou à défaut, de verser une contribution annuelle pour chacun des bénéficiaires de l’obligation qu’ils auraient dû employer.

Dans ce cadre, il était en principe prévu que l’effectif salarié annuel de l’employeur pris en compte corresponde à la moyenne des personnes employées au cours de chacun des mois de l’année civile précédente (N-1).

Cette règle vient de changer. Désormais, la période à retenir pour apprécier cet effectif salarié est l’année au titre de laquelle la contribution annuelle est due (soit l’année N).
