Un salarié, licencié pour inaptitude et impossibilité de reclassement, tout en contestant son licenciement, reproche à son ex-employeur de ne pas avoir respecté son obligation de formation à son égard, et réclame des dommages-intérêts. Et pourtant il a bien suivi des formations, rappelle l’employeur…


Obligation de formation = adaptation du salarié à son poste de travail

Un salarié employé en qualité de contrôleur interne, en litige avec son ex-employeur à propos d’un licenciement pour inaptitude et impossibilité de reclassement, reproche à son employeur de ne pas avoir respecté son obligation de formation. Il lui réclame donc 10 000 € de dommages-intérêts.

Mais l’employeur lui rappelle qu’il a tout de même suivi des formations, quasiment tous les ans, et notamment dans les domaines suivants : analyse technique multi marchés, contrôle interne, formation Excel, formation bureautique, formation neuro linguistique, certification AMF externe, journée de formation interne, etc.

En outre, l’employeur fait état de comptes rendus des réunions des représentants du personnel démontrant l’attention portée aux obligations de formation.

Mais cela ne suffit pas à démontrer que l’employeur a rempli ses obligations en matière de formation, estime le salarié : ce dernier rappelle que cette obligation suppose que l’employeur assure l’adaptation des salariés à leur poste de travail et veille au maintien de leur capacité à occuper un emploi, au regard notamment de l’évolution des emplois, des technologies et des organisations.

L’employeur doit rapporter la preuve que le salarié a bien bénéficié de formations adaptées à son poste, conteste le salarié, lequel rappelle qu’il a dû exercer les fonctions de collègues absents, et notamment celle de son responsable pendant quelques temps.

Ce que confirme le juge, lequel estime ici que la preuve que les formations suivies par le salarié étaient en adéquation avec son poste de travail au regard des nouvelles missions qui lui avaient été confiées n’est pas rapportée.
