Marchés publics : ce qui change au 1er janvier 2020 pour les PME

  • Moins de formalités pour les PME

Jusqu’à présent, lorsqu’un marché public était inférieur à 25 000 HT, il était passé sans publicité, ni mise en concurrence préalables. On parle alors de procédure simplifiée.

Depuis le 1er janvier 2020, le seuil des formalités simplifiées est désormais fixé à 40 000 € HT.

  • Plus d’avances financières pour les PME

Depuis le 1er janvier 2019, les PME titulaires de marchés publics conclus avec l’Etat bénéficient d’avances financières dont le taux est fixé à 20 % du montant du marché public.

Depuis le 1er janvier 2020, un dispositif identique a été mis en place pour les marchés publics conclus avec les établissements publics de l’Etat (hors hôpitaux publics) et avec les collectivités territoriales dont les dépenses de fonctionnement sont supérieures à 60 M€ / an.

Et, désormais, le montant minimum des avances versées aux PME par ces derniers est fixé à 10 % du montant du marché public.
