La loi Climat a été publiée le 24 août 2021. Elle comporte des mesures intéressant spécifiquement les commerçants et portant sur la vente en vrac, la distribution automatique d’échantillons gratuits et la mise en œuvre du dispositif de consigne. Que devez-vous savoir ?


Favoriser la vente en vrac

Au 1er janvier 2030, 20 % de la surface de vente des commerces dont la surface est supérieure à 400 m² devra être affectée à des produits présentés sans emballage primaire, comme ceux vendus en vrac.

Un décret à venir doit préciser cette mesure.

Par ailleurs, un arrêté ministériel fixera les modalités d’une expérimentation, menée sur une période de 3 ans, permettant de développer la vente des produits présentés sans emballage primaire dans les commerces de vente au détail d’une surface inférieure à 400 m².

Enfin, à compter du 1er janvier 2025, les emballages constitués pour tout ou partie de polymères ou de copolymères styréniques, non recyclables et dans l’incapacité d’intégrer une filière de recyclage, seront interdits.


Interdiction de la distribution automatique d’échantillons gratuits

Au plus tard le 1er juillet 2022, la distribution gratuite d’échantillons en l’absence de demande expresse du consommateur sera interdite.

Un décret à venir doit préciser cette mesure.


Favoriser la mise en œuvre de dispositifs de consigne

Des dispositifs de consigne pour réemploi peuvent être mis en œuvre pour les emballages en verre lorsque le bilan environnemental global est positif.

Ce bilan tient compte de la distance de transport parcourue par les emballages pour être réemployés.
