La loi Climat, qui a été publiée le 24 août 2021, vient modifier la règlementation encadrant la délivrance des autorisations d’exploitation commerciale pour limiter au mieux l’artificialisation des sols. Que faut-il retenir ?


Limiter l’artificialisation des sols

Désormais, il existe un nouveau principe général selon lequel la commission départementale d’aménagement commercial (CDAC) ne peut pas délivrer d’autorisation d’exploitation commerciale (AEC) lorsque l’implantation ou l’extension de la surface commerciale envisagée engendre une artificialisation des sols.

Cette impossibilité de délivrer une AEC est absolue en ce qui concerne les projets portant sur une surface de vente supérieure à 10 000 m².

Pour les surfaces de vente inférieure à 10 000 m², l’AEC peut être délivrée dès lors que le projet répond à un ou plusieurs critères, notamment :

  • qu’il s’insère dans le périmètre d’une opération de revitalisation du territoire (ORT) ou dans un quartier prioritaire de la politique de la ville (QPV) ;
  • qu’il s’insère au sein d’un espace déjà urbanisé, afin de favoriser notamment la mixité fonctionnelle du secteur concerné ;
  • que le projet fait l’objet d’une compensation de l’artificialisation qu’il engendre par la transformation d’un sol artificialisé en sol non artificialisé.

Un décret à venir précisera cette mesure.

Par ailleurs, dans les communes de moins de 20 000 habitants, le maire (ou le président de l’intercommunalité) peut, lorsqu’il est saisi d’une demande de permis de construire un équipement commercial dont la surface est comprise entre 300 et 1 000 m², proposer au conseil municipal ou au conseil de l’intercommunalité de saisir la CDAC pour qu’elle se prononce sur la conformité du projet à la réglementation.

Désormais, pour les projets qui engendrent une artificialisation des sols, cette saisine de la CDAC pourra être faite dans toutes les communes, quelle que soit leur taille.
