Copropriété : pas d’activité commerciale dans les appartements ?

Le règlement de copropriété d’un immeuble situé à Paris prévoit que tous les appartements sont à usage d’habitation et que l’usage de locaux à usage professionnel n’est autorisé que si l’activité a été exercée dès l’origine, dans des locaux annexes à ceux servant à l’habitation du propriétaire.

En conséquence, les appartements ne peuvent pas être utilisés au titre d’une activité commerciale.

Selon le syndicat des copropriétaires, ce point du règlement n’a pas été respecté par l’un des copropriétaires (une SCI) : celle-ci propose, en effet, à la location saisonnière (à la journée ou à la semaine) les 39 appartements qu’elle possède dans l’immeuble.

Mais la SCI estime n’avoir enfreint aucune réglementation et, au contraire, que le règlement de copropriété est illicite puisqu’il porte atteinte à son droit de propriété.

« Faux », répond le juge : le règlement de copropriété est tout à fait régulier et peut valablement interdire l’exploitation d’une activité commerciale dans les appartements. En outre, la SCI ne précise pas en quoi son droit de propriété serait concrètement atteint…

La SCI doit donc ici mettre fin à l’activité commerciale qu’elle réalise au moyen de ces 39 appartements.
