Un salarié est licencié pour inaptitude. Mais il constate que l’employeur l’a convoqué à son entretien préalable avant même d’avoir recueilli l’avis des représentants du personnel quant aux potentiels reclassements le concernant. De quoi rendre le licenciement abusif, selon lui…


Un avis requis préalablement à toute procédure de licenciement !

Une entreprise est dotée d’un seul représentant du personnel et ce salarié est déclaré inapte à son poste.

Parce que son employeur envisage d’engager une procédure de licenciement pour inaptitude, il lui adresse 2 courriers, le même jour : l’un pour le convoquer, en qualité de représentant du personnel, afin de le consulter au sujet des possibilités de reclassement le concernant, l’autre pour le convoquer à un entretien préalable à un éventuel licenciement… Licenciement qu’il finit par effectivement prononcer.

Ce que le salarié conteste : il rappelle que l’employeur doit avoir consulté les représentants du personnel « avant » d’engager la procédure de licenciement. Ce qui n’a pas été le cas ici : l’employeur lui a adressé, en tant que représentant du personnel, un courrier en vue de le consulter à propos des reclassements possibles ; et, « le même jour », il lui a envoyé sa convocation à un entretien préalable, celui-ci marquant l’engagement de la procédure de licenciement.

Ce que confirme le juge. Et parce que l’employeur a recueilli l’avis du salarié en sa qualité de représentant du personnel après l’avoir convoqué à son entretien préalable, le licenciement est, en réalité, sans cause réelle et sérieuse.
