A la suite d’une vente de titres de société, un père, qui a réalisé un gain important demande, pour le calcul de son impôt, à imputer les pertes de même nature réalisées par son fils majeur appartenant au même foyer fiscal. Ce que lui refuse l’administration, qui constate qu’au jour de la demande, le fils n’est justement plus rattaché à ce foyer fiscal…


Imputation des pertes et foyer fiscal : quid du détachement d’un enfant majeur ?

A la suite de la vente de titres de société, un père de famille réalise un gain (appelé « plus-value ») sur lequel il est soumis à l’impôt sur le revenu.

Pour diminuer le montant de cet impôt, il décide de soustraire du montant du gain qu’il déclare le montant des pertes de même nature (appelées « moins-values ») réalisées par son fils majeur 8 ans auparavant.

Pour lui, cette soustraction (appelée « imputation ») est possible, puisque son fils était encore rattaché à son propre foyer fiscal lorsqu’il a subi ces moins-values.

Sauf qu’au jour de la demande d’imputation, le fils en question n’est plus rattaché au foyer fiscal de son père, constate l’administration.

Dès lors, les moins-values non encore utilisées subies par le fils au titre d’une année au cours de laquelle il était rattaché au foyer fiscal de son père, ne peuvent pas être conservées et utilisées par ce dernier après que son fils a quitté le foyer fiscal.

Ce que confirme le juge, qui rejette à son tour la demande du père.
