Dans une mise à jour du 25 juin 2021, le Bulletin officiel de la Sécurité sociale (BOSS) apporte une précision quant au remboursement des frais professionnels engagés par les gérants de SARL et de SELARL… Que faut-il en retenir ?


SARL, SELARL : gérants minoritaires = gérants égalitaires ?

Les gérants minoritaires de SARL (société à responsabilité limitée) et de SELARL (société d’exercice libéral à responsabilité limitée), parce qu’ils sont assimilés salariés et affiliés au régime général de Sécurité sociale, peuvent bénéficier d’un remboursement de frais professionnels, à condition que ces frais soient des charges :

  • inhérentes à leur fonction,
  • supportées par eux dans l’accomplissement de leur mission dans l’entreprise.

Notez que ce remboursement ne peut s’effectuer que sur la base des dépenses réellement engagées.

A des fins de simplification, les frais professionnels des gérants minoritaires de SARL et de SELARL utilisant leur véhicule à des fins professionnelles peuvent cependant être déduits, pour le calcul des cotisations sociales, sur la base d’un barème kilométrique forfaitaire, publié annuellement par l’administration fiscale.

Depuis le 25 juin 2021, l’administration sociale est venue également offrir cette possibilité aux gérants égalitaires des SARL et SELARL.
