Lorsqu’un salarié d’un établissement ou d’un service social ou médico-social dénonce des mauvais traitements ou des privations infligé(e)s à un patient, il bénéficie par principe d’une protection contre le licenciement. Mais, comme souvent, il existe des exceptions…


Une protection du dénonciateur… avec ou sans conditions ?

Dans les établissements et services sociaux et médico-sociaux, il n’est pas possible de prendre de mesures défavorables à l’encontre d’un salarié parce qu’il aurait relaté ou témoigné de mauvais traitements ou de privations infligé(e)s à une personne accueillie.

Si ce salarié faisait l’objet d’un licenciement pour cette raison, il pourrait obtenir sa réintégration dans l’établissement.

Dans une affaire récente, un médecin (salarié) a signalé à l’association qui l’emploie le délaissement d’une patiente, constituant, selon ce médecin, un acte de maltraitance. Mais, quelques jours plus tard, l’employeur a engagé, à son encontre, une procédure disciplinaire, débouchant finalement sur le licenciement pour faute grave du médecin.

Dans la lettre de licenciement, l’employeur lui reproche un manquement à ses obligations déontologiques, d’avoir eu une attitude préjudiciable à l’association et particulièrement d’avoir trouvé un « prétexte fallacieux » (l’existence d’actes de maltraitance au sein de l’association) pour détourner la clientèle de l’association.

Selon le médecin, le lien évident entre sa dénonciation et son licenciement justifie l’annulation de son licenciement.

Mais le juge est plus nuancé : selon lui, la protection garantie au salarié qui a dénoncé des actes de maltraitance ne joue pas s’il a dénoncé de mauvaise foi les mauvais traitements. L’affaire sera donc rejugée pour établir si, dans cette affaire, le médecin était ou non de mauvaise foi.
