Un boulanger-pâtissier fait l’objet d’un contrôle Urssaf : l’inspecteur constate, par 3 visites, que la mère du gérant de l’entreprise y travaille régulièrement et contrôle le travail des salariés. Ce qui constitue du travail dissimulé, d’après l’Urssaf, qui exige alors le paiement de cotisations sociales…


Entraide familiale = entraide ponctuelle ?

A l’occasion du contrôle d’une boulangerie-pâtisserie, l’inspecteur de l’Urssaf relève que la mère du gérant est très présente dans l’activité de l’entreprise. Or, elle n’est pas déclarée. Il y voit là un travail « dissimulé ».

« Pas du tout ! », conteste l’entrepreneur. Il rappelle à l’inspecteur qu’un salarié reçoit une rémunération, ce qui n’est pas le cas de sa mère. Certes, convient l’inspecteur de l’Urssaf, mais sa participation durable, régulière et permanente à l’activité de l’entreprise excède les limites de l’entraide familiale.

De plus, ajoute-t-il, elle contrôle les vendeurs de l’entreprise. Il existe donc un lien de subordination. « Impossible », selon le boulanger qui considère que sa mère ne peut pas être sa subordonnée.

Après ce contrôle, le boulanger effectue une déclaration préalable à l’embauche de sa mère. L’inspecteur de l’Urssaf y voit là la reconnaissance du statut de salarié pour la mère du boulanger et procède alors au redressement de l’entreprise.

Mais le juge rappelle à l’Urssaf que le lien de subordination entre la mère du gérant et l’entreprise n’est pas caractérisé et il s’agit d’une condition incontournable du salariat. De plus, la déclaration préalable à l’embauche la concernant n’a pas d’effet rétroactif : la mère du boulanger n’était donc pas, lors du contrôle, salariée de l’entreprise. Le redressement est annulé.
