Lorsqu’une entreprise refuse de fournir à l’administration fiscale l’identité du bénéficiaire d’une distribution dite « occulte », elle s’expose à de lourdes sanctions financières. Ces sanctions sont-elles légales ?


Distributions « occultes » : des sanctions proportionnées aux manquements constatés !

Lorsqu’à l’issue du contrôle fiscal d’une entreprise, l’administration constate l’existence d’une distribution « occulte », elle peut exiger de l’entreprise qu’elle lui fournisse, dans un délai de 30 jours, l’identité du bénéficiaire de cette distribution.

Pour mémoire, on parle de distribution « occulte » en présence de sommes versées à des personnes non identifiées, que l’entreprise déduit, à tort, de son revenu imposable.

Si l’entreprise décide de ne pas répondre, ou de répondre de façon évasive à cette demande, elle devra verser une pénalité à l’administration d’un montant égal à 100 % de la somme distribuée.

En revanche, si elle réintègre spontanément dans son résultat imposable la somme versée, le montant de la pénalité due est abaissé à 75% du montant de la somme distribuée.

A l’occasion d’un litige l’opposant à l’administration fiscale, une société a demandé au juge de reconnaître l’illégalité de ces sanctions, considérant qu’elles sont contraires aux règles européennes protégeant la propriété.

Une demande rejetée par le juge, pour qui ces sanctions sont parfaitement proportionnées aux manquements qu’elles répriment.
