Le dirigeant d’une société placée en liquidation judiciaire est condamné à prendre en charge ses dettes. A tort, selon lui, étant donné que les fautes qu’on lui reproche ne sont pas (si) graves…


L’attitude du dirigeant en question

A la suite de la mise en liquidation judiciaire de sa société, un dirigeant se voit reprocher diverses fautes de gestion : il a, en effet, omis de recouvrer le paiement de diverses factures relatives à des chantiers pour lesquels la société avait pourtant commandé des stocks et a passé des commandes de marchandises trop importantes au regard des contrats conclus par la société.

Autant de décisions qui ont, selon le liquidateur judiciaire, contribué à fragiliser l’équilibre financier de la société et qui justifient que le dirigeant soit condamné à prendre en charge ses dettes.

« Des erreurs d’inattention », minimise l’intéressé, qui rappelle qu’il ne peut pas être condamné à combler les dettes de la société pour de simples négligences…

Un argument qui ne convainc toutefois pas le juge : en adoptant délibérément un comportement inadapté à la situation financière de sa société, le dirigeant a sciemment décidé de ne plus en assurer une gestion cohérente.

Dès lors, les manquements qui lui sont reprochés ne constituent pas de « simples négligences », mais bel et bien des fautes de gestion qui ont contribué à aggraver les dettes de la société… que le dirigeant doit donc prendre en charge.
