Deux sociétés de vente de pizzas à domicile s’accusent mutuellement de dénigrement et de concurrence déloyale. Mais est-il nécessaire que l’une et l’autre prouvent l’existence d’un préjudice pour obtenir, chacune, une indemnisation ? Pas si sûr….


Dénigrement et concurrence déloyale impliquent nécessairement un préjudice !

Deux sociétés de livraison de pizzas à domicile, A et B, interviennent sur le même secteur géographique. Mais la société A reproche à la société B de l’avoir dénigrée en diffusant sur Internet des propos dévalorisants à son encontre.

« Et alors ? » répond la société B : rien ne prouve que la diffusion de ces propos ait causé un quelconque préjudice à la société A. Et sans préjudice, pas d’indemnisation !

En plus, accuse la société B à son tour, la société A a accordé des prêts illicites à ses franchisés, assortis notamment d’importants délais de paiement. Or, cela constitue une pratique de concurrence déloyale, qui lui permet, en tant que société concurrente, d’obtenir une indemnisation !

« Sauf qu’il n’y a pas ici de préjudice non plus ! » rétorque la société A, reprenant les arguments de la société B.

En clair, les sociétés A et B refusent de se verser une indemnisation en raisonnant de la même manière : sans preuve d’un préjudice, l’autre n’a pas le droit à une indemnisation…

« A tort !», répond le juge : un dénigrement ou une pratique de concurrence déloyale, dûment établi, causent nécessairement préjudice pour la société victime ou concurrente.

Par conséquent, la société B doit indemniser la société A pour l’avoir dénigrée, et la société A doit indemniser la société B pour avoir commis une pratique de concurrence déloyale.
