Par principe, les bénéfices réalisés par une EURL (entreprise unipersonnelle à responsabilité limitée) sont normalement imposables, chez l’associé, à l’impôt sur le revenu dans la catégorie des bénéfices industriels et commerciaux.

Si, au titre d’un exercice, il constate un déficit d’exploitation, ce déficit vient, en application de la réglementation fiscale, diminuer le revenu global de l’associé pour le calcul de son impôt sur le revenu.

C’est ce que réclame l’associé unique d’une EURL, dans une récente affaire, mais que lui refuse l’administration fiscale : elle rappelle que la règle qui admet l’imputation du déficit sur le revenu global suppose la participation personnelle, continue et directe de l’associé (ou de l’un des membres du foyer fiscal) à l’accomplissement des actes nécessaires à l’activité de l’entreprise.
