En principe, la déclaration de succession doit être déposée dans les 6 mois du décès. Mais est-ce une obligation absolue ?

A la suite du décès d’une personne, les héritiers doivent déposer une déclaration de succession auprès de l’administration fiscale dans un délai de 6 mois à compter du décès. A défaut, ils peuvent être tenus de verser des intérêts de retard.

En pratique, c’est le notaire qui procède à cette déclaration.

Mais que se passe-t-il si le délai de 6 mois n’est pas respecté ?

Si le notaire n’a pas accompli toutes les diligences nécessaires, sa responsabilité peut être engagée.
