Face à la propagation du coronavirus responsable de l’épidémie de covid-19, le Gouvernement a mis en place, et modifié à plusieurs reprises, un protocole national sanitaire. Mais ce protocole a-t-il réellement valeur de Loi pour qu’il s’impose à l’employeur ?

Des syndicats ont reproché au protocole sanitaire national de prévoir des mesures plus restrictives de liberté que la Loi elle-même. Rappelons, à titre d’exemple, qu’il impose le port du masque en entreprise, et par conséquent aux salariés. Ces syndicats estimaient donc que son application devait être suspendue.

Mais pour le juge, qui maintient son application, le protocole sanitaire constitue un ensemble de recommandations pour la déclinaison matérielle de l’obligation de sécurité de l’employeur dans le cadre de l’épidémie de covid-19 en rappelant les obligations imposées par la Loi.

Et alors que l’absence de protocole ne dispenserait pas l’employeur de son obligation de sécurité, sa publication permet de prendre les mesures pertinentes propres à assurer efficacement la sécurité des personnes.
