La crise sanitaire touche l’ensemble des ménages français dont certains peuvent se trouver en situation de découvert bancaire. Le Gouvernement envisage-t-il une solution pour mettre un terme, temporairement, aux agios et aux pénalités réclamées par les banques ? Réponse…


Coronavirus (COVID-19) : les agios et pénalités bancaires restent dus !

La crise sanitaire contraint bon nombre d’entreprises à mettre en place des mesures d’activité partielle et de chômage technique pour leurs salariés.

Dans l’attente de leur indemnisation à ce titre, ces derniers peuvent rencontrer des difficultés financières susceptibles de générer un décompte d’agios et de pénalités par les banques.

Récemment interrogé sur la possibilité de demander aux banques de renoncer à ces frais en raison de la crise sanitaire et économique, le Gouvernement vient de répondre par la négative.

A l’appui de sa réponse, il rappelle que les frais d’incidents bancaires ont été plafonnés à 25 € par mois pour les clients les plus fragiles au titre de l’année 2020.

Ces frais plafonnés ne comprennent toutefois pas les agios, dans la mesure où la majorité des contrats de crédit comprennent déjà des clauses permettant aux ménages emprunteurs de différer temporairement le remboursement de leurs échéances en cas de dégradation de leur situation professionnelle.

Ceux-ci peuvent en outre demander la mise en place de « délais de grâce » auprès du juge, notamment en cas de licenciement, en vue de suspendre temporairement le remboursement de leurs crédits sur une durée maximale de 2 ans.

Autant de mesures existantes qui légitiment, selon le Gouvernement, le principe de paiement des agios, même par temps de crise.
