Contrôle Urssaf : l’inspecteur doit répondre à vos observations !

L’Urssaf notifie une lettre d’observations à une société un 5 janvier 2010. Par mail, le conseil de cette société sollicite un délai jusqu’au 26 février suivant pour répondre aux observations de l’URSSAF, délai qui lui a été accordé par l’inspecteur du contrôle (par mail du 8 février).

Le 26 février, la société adresse alors à l’Urssaf un courrier pour contester le redressement envisagé, observations qui sont donc intervenues dans les délais.

Le 12 novembre suivant, l’URSSAF a mis en recouvrement les cotisations faisant l’objet du redressement sans avoir répondu aux observations de la société. L’inspecteur du recouvrement n’a fait que prendre acte des observations de la société, mais sans y répondre.

Or, selon la société qui réclame l’annulation du redressement, la mise en recouvrement des cotisations, majorations et pénalités de retard faisant l’objet du redressement ne peut pas intervenir avant que l’inspecteur ait répondu aux observations de l’employeur.

Ce que confirme le juge qui annule le redressement.
