Un bailleur estime que la procédure de notification d’un congé pour reprise d’un bail rural prorogé est impossible à respecter dans une situation précise : lorsqu’il reste moins de 18 mois avant l’expiration du bail prorogé. A tort ou à raison ?


Assouplissement de la procédure de notification d’un congé pour reprise

Actuellement, la réglementation prévoit qu’un bailleur rural qui a valablement délivré un congé pour reprise, auquel l’agriculteur s’est opposé en raison de son âge proche de la retraite pour obtenir la prorogation de son bail, doit délivrer un nouveau congé pour pouvoir effectivement reprendre son bien à l’issue de cette prorogation.

Pour être valable, ce nouveau congé doit être délivré au moins 18 mois avant l’expiration du bail prorogé.

Or, lorsque l’agriculteur s’oppose à la reprise moins de 18 mois avant l’expiration de la période de prorogation, le bailleur est placé dans l’impossibilité de notifier un nouveau congé dans le délai imparti.

Un point de la réglementation qui est illicite, selon le juge, mais qui va continuer à s’appliquer jusqu’au 31 décembre 2022 afin de sécuriser les baux en cours.

Notez que jusqu’à l’entrée en vigueur d’une nouvelle loi changeant cette réglementation, ou jusqu’au 31 décembre 2022 au plus tard, en cas d’opposition de l’agriculteur à la reprise du bail, le bailleur n’est pas tenu de délivrer un nouveau congé si la durée de la prorogation du bail résultant de cette opposition est inférieure à 18 mois.
