Constatant que son ancien gérant détourne les sites internet qu’elle a conçus pour la clientèle de sa nouvelle entreprise, une société réclame une indemnisation… Ce qu’il refuse : puisque la société n’a pas perdu de chiffre d’affaires, elle n’a pas subi de préjudice… Qu’en pense le juge ?


Concurrence déloyale et parasitisme : l’obtention d’une indemnisation

Pour mémoire, le parasitisme constitue un acte de concurrence déloyale dès lors qu’une société s’immisce dans le sillage d’une autre, pour profiter de son savoir-faire sans avoir effectué d’investissements financiers, matériels ou même intellectuels.

Or, si l’ancien gérant ne conteste pas avoir effectué un tel détournement, il précise que cela n’a pas causé de préjudice à la société puisqu’elle ne démontre pas avoir subi de perte de chiffre d’affaires. La demande d’indemnisation n’est donc pas, selon lui, justifiée.

« Peu importe ! », selon son ancienne société, puisque le simple fait de profiter des efforts et des investissements intellectuels, matériels ou promotionnels d’un concurrent constitue un avantage concurrentiel indu engendrant un préjudice indemnisable.
