Une fondation chargée de gérer une appellation d’origine protégée (AOP) reproche à un commerçant de vendre des fromages en utilisant des étiquettes qui comportent un dessin évoquant l’aire géographique liée à l’AOP.

Or, pour se prévaloir de l’AOP et vendre son fromage, il faut respecter un cahier des charges précis, ce que ne fait pas le commerçant. La fondation estime donc que ce commerçant ne peut pas utiliser le dessin litigieux.

Ce que va confirmer le juge, qui rappelle que l’utilisation d’images évoquant une aire géographique à laquelle est liée une AOP peut constituer une évocation illicite de celle-ci lorsque le consommateur est amené directement à faire un lien entre l’image et le produit bénéficiant de l’AOP.
